By accessing or using TikWa.Link ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Winz Tech Hub LTD ("Company," "we," "us," or "our"). Please read them carefully.

2. Description of Service

TikWa.Link is a link management and lead collection platform that enables users to:

• Create shortened links that redirect TikTok audiences to WhatsApp
• Collect contact information (name, phone, email) from visitors through landing pages
• View analytics on link clicks and visitor data
• Export collected contacts to Google Contacts (with authorization)
• Manage and organize collected leads

3. Account Registration and Security

3.1 Account Creation

• You must be at least 13 years old (or 16 in the EU) to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Non-payment of fees (for paid plans)

4. Acceptable Use Policy

4.1 Permitted Uses

You may use TikWa.Link for legitimate business and personal purposes, including:

• Directing social media traffic to WhatsApp for customer engagement
• Collecting leads for marketing and sales purposes (with proper consent)
• Tracking and analyzing link performance

4.2 Prohibited Uses

You may NOT use TikWa.Link for:

• Spam or Unsolicited Messages: Sending unwanted bulk messages or spam
• Phishing or Fraud: Attempting to deceive users or steal information
• Malware Distribution: Distributing viruses, malware, or harmful code
• Illegal Content: Linking to illegal content, pirated materials, or prohibited goods
• Harassment or Abuse: Harassing, threatening, or abusing others
• Adult Content: Linking to pornographic or sexually explicit content
• Hate Speech: Promoting violence, discrimination, or hatred
• Intellectual Property Infringement: Violating copyrights, trademarks, or other IP rights
• Data Scraping: Unauthorized scraping or harvesting of user data
• System Abuse: Attempting to bypass security measures or overload systems

6.1 Your Responsibilities

When collecting contact information through TikWa.Link, you must:

• Obtain proper consent from individuals before collecting their data

• Use collected data only for lawful purposes
• Secure and protect collected contact information
• Honor opt-out and deletion requests from contacts

6.2 Our Role

TikWa.Link acts as a data processor. You (the user) are the data controller responsible for:

• Determining the purposes and means of processing contact data
• Ensuring legal compliance for data collection
• Providing appropriate privacy notices
• Handling data subject requests (access, deletion, etc.)

7. Subscription Plans and Payments

7.1 Free Plan

• Limited features as described on our pricing page
• Subject to usage limits (links, clicks, contacts)
• May include branding ("Powered by TikWa.Link")

7.2 Paid Plans

• Billed monthly or annually as selected
• Prices are subject to change with 30 days' notice
• Payment processed through secure third-party processors
• Automatic renewal unless cancelled before renewal date

7.3 Refunds

• No refunds for partial months or unused time
• Refunds may be considered on a case-by-case basis within 7 days of initial purchase
• Cancellation does not entitle you to a refund

7.4 Cancellation

• You may cancel your subscription at any time from Settings
• Access continues until the end of the billing period
• No charges after cancellation, but data may be deleted after grace period

8. Intellectual Property Rights

8.1 Our Content

The Service and its content (design, code, logos, text, graphics) are owned by or licensed to us and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or create derivative works
• Reverse engineer or decompile the Service
• Remove or alter any proprietary notices
• Use our trademarks without written permission

8.2 Your Content

You retain ownership of content you create (links, contact data, etc.). By using the Service, you grant us a license to:

• Store and process your content to provide the Service
• Display your content as necessary for Service functionality
• Create backups of your content

This license ends when you delete your content or close your account.

9. Analytics and Usage Data

We collect and analyze data about how the Service is used, including:

• Link click data and visitor analytics
• Geographic information (country, region, city)
• Device and browser information
• Referrer information

This data helps us improve the Service. Aggregated, anonymized data may be used for research and marketing purposes.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12.3 Indemnification

You agree to indemnify, defend, and hold us, our affiliates, partners, officers, directors, employees, agents, and licensors harmless from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:
